No entanto, por causa de toda essa agilidade, os motociclistas são constantemente vítimas dos mais diversos tipos de acidente — como se trata de um meio de transporte que não oferece uma carenagem como proteção, normalmente quem está guiando pode acabar sofrendo sérios danos, o que justifica o adicional de periculosidade para essa profissão. O que é o adicional de periculosidade?
O adicional de periculosidade é um benefício garantido aos trabalhadores que ocupam cargos e atividades que são consideradas perigosas pela lei. Encaixa-se nesse quadro toda atividade de trabalho que expõe esse tipo de profissional a situações de perigo e alto risco de morte ou de danos à sua integridade física, pela própria natureza da profissão ou dos métodos usados por ela. O valor desse adicional é de 30% do salário bruto do empregado — sem levar em conta qualquer tipo de bonificação, prêmio ou participação nos lucros da empresa.
Como funciona a lei para os motoboys?
Trabalhadores expostos a situações de risco em função de seu ofício já tinham direito a esse adicional — como é o caso de bombeiros, policiais, médicos que atuam em áreas de risco, dentre outros. No entanto, os motoboys não estavam incluidos nessa categoria, e foi necessária a criação de uma nova lei que lhes desse esse direito. Em junho de 2014 essa lei finalmente foi redigida, e começou a valer para os profissionais da área em outubro do mesmo ano. A lei garante a qualquer trabalhador de motoentregas ou que atue nesse tipo de serviço uma bonificação igual à de quaisquer outros profissionais que atuam em situações de perigo — ou seja, um adicional de 30% de seu salário base. Estão incluídos aí os motoboys, motofrentistas, mototaxistas e quaisquer outros indivíduos que precisem andar de motocicleta ou motoneta para exercer sua profissão.
Todo motociclista tem direito ao adicional?
Só tem direito a receber esse adicional os empregados que são regidos pela Consolidação das Leis do Trabalho (CLT) que utilizem a motocicleta ou motoneta durante a jornada de trabalho. Quem usa o veículo apenas como meio de transporte, mesmo que seja para se deslocar até o local de trabalho, não se inclui entre os beneficiários — e, portanto, não tem o direito de receber o adicional.
É dessa forma que o adicional de periculosidade funciona para motoboys e outros profissionais que dependem de suas motocicletas para trabalhar. É um benefício justo e válido, já que esse tipo de serviço realmente coloca em risco constante a vida e a integridade física de quem o faz. Ainda mais com o trânsito intenso e violento dos dias de hoje, esse adicional pode realmente fazer a diferença na hora em que o trabalhador mais precisar!
