Dentro da legislação trabalhista traçada pela CLT, o art. 162 estabelece que as empresas se fazem obrigadas a manter serviços especializados em segurança e em medicina do trabalho, conforme as normas a serem expedidas pelo Ministério do Trabalho e Emprego (MTE). Esse órgão federal, utilizando seu poder disciplinador, fixou inúmeras Normas Regulamentadoras, dentre as quais a NR-5, que trata da Comissão Interna de Prevenção de Acidentes (CIPA).

O que é a CIPA?

A Comissão Interna de Prevenção de Acidentes é um grupo constituído por pessoas pré-selecionadas, cujo maior propósito é a prevenção de acidentes e enfermidades decorrentes do trabalho, de modo a melhorar as condições ambientais nos espaços laborais, preservar a vida e promover a saúde e o bem-estar dos trabalhadores. Esse instrumento interno é formado por representantes do empregador e dos funcionários, em igual quantidade, para cumprir mandatos que duram um ano.

Como a CIPA é constituída?

A legislação específica indica que o grupo seja dimensionado de acordo com dois aspectos:

  • O número de trabalhadores;
  • e o grau de risco que a empresa proporciona ao seu quadro.

A NR-5 dispõe de uma tabela (no Quadro III), onde o gestor da empresa poderá descobrir o grupo ao qual ela pertence para, em seguida, verificar, no Quadro I do mesmo regulamento, o número de efetivos e de suplentes que sua CIPA deverá abranger. Nos casos em que a empresa não possui o número mínimo de trabalhadores para constituição de uma CIPA, deverá ser escolhido ao menos um profissional que represente a comissão e cumpra os afazeres inerentes a ela.

A partir de quando a CIPA deve ser instalada na empresa?

O segundo dispositivo da NR-5 indica o rol das organizações que devem constituir uma CIPA e mantê-la em regular funcionamento. São elas:

  • As empresas privadas e as públicas;
  • sociedades de economia mista;
  • órgãos da administração direta e indireta;
  • instituições beneficentes;
  • associações recreativas;
  • cooperativas e as demais instituições que admitam trabalhadores como empregados.

Assim, quando se atinge a quantidade mínima de empregados que a legislação exige para a instalação da CIPA, tal comissão precisa ser providenciada.

Como a CIPA funciona?

A comissão tem diversas atribuições, todas apontadas em regulamento, entre as quais podem ser citadas:

  • A identificação dos riscos do processo de trabalho e a elaboração de um mapa desses riscos;
  • a participação da implementação e do controle das medidas de prevenção necessárias ao local de trabalho;
  • a verificação periódica dos ambientes e condições de trabalho;
  • a ampla divulgação, aos trabalhadores, de informações que concernem a segurança e a saúde nos espaços laborais, entre outras.

Com que frequência e quando devem ocorrer as reuniões da CIPA?

A fim de cumprir suas tarefas, a CIPA faz reuniões mensais ordinárias de acordo com um calendário delineado previamente e que, vale ressaltar, ocorrem dentro da jornada normal de trabalho, e não fora do horário de expediente. Entretanto, reuniões extraordinárias podem acontecer em caso de denúncia de risco grave e iminente, ocorrência efetiva de um acidente de trabalho grave ou fatal, ou por conta de solicitação de uma das representações.

As deliberações feitas em qualquer das reuniões ficarão registradas em atas, que devem permanecer à disposição da fiscalização do MTE.
